You represent and warrant that: (i) you have the legal right to use any card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.

We may employ the use of third party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.

We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.

We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

4. Contests, Sweepstakes and Promotions

Any contests, sweepstakes or other promotions (collectively, “Promotions”) made available through Service may be governed by rules that are separate from these Terms of Service. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms of Service, Promotion rules will apply.

5. Subscriptions

Some parts of Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles will be set depending on the type of subscription plan you select when purchasing a Subscription.

At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or Get Clicker cancels it. You may cancel your Subscription renewal either through your online account management page or by contacting contact@getclicker.com customer support team.

A valid payment method is required to process the payment for your subscription. You shall provide Get Clicker with accurate and complete billing information that may include but not limited to full name, address, state, postal or zip code, telephone number, and a valid payment method information. By submitting such payment information, you automatically authorize Get Clicker to charge all Subscription fees incurred through your account to any such payment instruments.

Should automatic billing fail to occur for any reason, Get Clicker reserves the right to terminate your access to the Service with immediate effect.

6. Free Trial

Get Clicker may, at its sole discretion, offer a Subscription with a free trial for a limited period of time ("Free Trial").

You may be required to enter your billing information in order to sign up for Free Trial.

If you do enter your billing information when signing up for Free Trial, you will not be charged by Get Clicker until Free Trial has expired. On the last day of Free Trial period, unless you cancelled your Subscription, you will be automatically charged the applicable Subscription fees for the type of Subscription you have selected.

At any time and without notice, Get Clicker reserves the right to (i) modify Terms of Service of Free Trial offer, or (ii) cancel such Free Trial offer.

7. Fee Changes

Get Clicker, in its sole discretion and at any time, may modify Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.

Get Clicker will provide you with a reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.

Your continued use of Service after Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.

8.Refunds

We don’t provide any kind of refund at any time

9.Content

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material (“Content”). You are responsible for Content that you post on or through Service, including its legality, reliability, and appropriateness.

By posting Content on or through Service, You represent and warrant that: (i) Content is yours (you own it) and/or you have the right to use it and the right to grant us the rights and license as provided in these Terms, and (ii) that the posting of your Content on or through Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity. We reserve the right to terminate the account of anyone found to be infringing on a copyright.

You retain any and all of your rights to any Content you submit, post or display on or through Service and you are responsible for protecting those rights. We take no responsibility and assume no liability for Content you or any third party posts on or through Service. Get Clicker has the right but not the obligation to monitor and edit all Content provided by users.

Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of Get Clicker and its licensors. Service is protected by copyright, trademark, and other laws of and foreign countries. Our trademarks may not be used in connection with any product or service without the prior written consent of Get Clicker.

15. Copyright Policy

We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on Service infringes on the copyright or other intellectual property rights (“Infringement”) of any person or entity.

You may be held accountable for damages (including costs and attorneys’ fees) for misrepresentation or bad-faith claims on the infringement of any Content found on and/or through Service on your copyright.

If studio owner/ User is unsatisfied with the freelancer/ studio work, getclicker will not be liable for the same

Both freelancer and studio owner should co-ordinate effectively with each other to get the best result.Also, studio owner is responsible to provide the quality of service to the user

Though get-clicker strive to provide the best services to the user of the app

The freelancer has to bear the cost of travelling to venue. In an unfortunate event If something happens to the freelancer while travelling, the freelancer alone would be responsible for the events and results.Getclicker won’t bear any medication cost or any penalty

GETCLICKER SHALL NOT BE LIABLE FOR DELAY OR FAILURE IN PERFORMANCE RESULTING FROM CAUSES BEYOND GETCLICKER’S REASONABLE CONTROL.

GETCLICKER MAKES NO REPRESENTATION, WARRANTY, OR GUARANTEE REGARDING THE RELIABILITY, TIMELINESS, QUALITY, SUITABILITY OR AVAILABILITY OF THE SERVICES OR ANY SERVICES OR GOODS REQUESTED THROUGH THE USE OF THE SERVICES, OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. getclicker.com (“Get Clicker”) is governed by the Indian Legal Regulation. The APPs regulate how personal information is handled by getclicker.com

The types of personal information we collect and hold

We collect personal information about our users in order provide our products, services, and customer support. Our products, services, and customer support are provided through many platforms including but not limited to: websites, phone apps, email, and telephone. The specific platform and product, service, or support you interact with may affect the personal data we collect.

Not all information requested, collected, and processed by us is “Personal Information” as it does not identify you as a specific natural person. This will include majority of “User Generated Content” that you provide us with the intention of sharing with other users. Such “Non-Personal Information” is not covered by this privacy policy. Users can stop us from collecting data from other platforms by removing our access on the other platform or by contacting our support team.

Users have the ability to invite non-users to our platform by providing contact details such as email address. In these situations, the information will be collected and stored by us to contact the non-user and to prevent abuse of the invite systems.

Human review of automated decision making / profiling – In the case of our ranking algorithms, it is not possible to exercise this right as this ranking is a fundamental part of the marketplace that users participate in, opting out would mean not being able to participate in the marketplace. Decisions affecting marketplace security are already reviewed by humans.

Direct marketing and profiling – users can control what emails they receive through their settings page.

Erasure – Most personal information and user generated content cannot be deleted as they are used to support contracts between users, document financial transactions, and are used in providing protecting other legitimate users of the marketplace. In the case of non-personal data that can be linked with personal data, it will either be erased or otherwise anonymised from the personal data.

Temporary restriction to processing – under certain circumstances you may exercise this right, in particular if you believe that the personal data we have is not accurate, or you believe that we do not have legitimate grounds for processing your information. Refund Policy

1. GENERAL

2. DEFINITIONS

3. REFUNDS RULES

• Every effort is made so as to service the orders placed, as per the specifications and timelines mentioned with respect to a Products and Services. If due to any unforeseen circumstances or limitations from Our side, the order is not shipped or delivered then such order stands cancelled, and the amount paid by You is refunded.
• You can cancel the order after the Date of Transaction and prior to the dispatch of the product. The order cannot be cancelled once the dispatch has been initiated.
• We will not process a return if You have placed the order for the wrong product model, color, or incorrect product or service.
• Return or refund shall only be considered once the Customer concerned produces relevant documents and proof.
• If following the testing process, the product is found to be in good working order without defects, We will return the product to you, and the carriage costs of this return will be Your responsibility.
• Once qualified, the refunds are applied to the original payment option.
• Please be informed that the products purchased using the Cash on Delivery option will be refunded to the Bank account with the details provided by you to Us.

4. PRODUCTS DAMAGED DURING THE TRANSIT

• Replacement can be made if the Customer establishes that the product was delivered in defective condition or has physical damage within 48 hours of receipt of the product.
• Any damaged product must be returned in the condition it was in when you received it, together with any packaging and other items which You received with the damaged product.

5. ORDER NOT CONFIRMED BUT AMOUNT DEDUCTED

• If the amount has been deducted and the order is not confirmed, please do contact Your respective bank. It takes 7 (seven) Business Days to reverse back the amount by the respective bank.

6. EXEMPTIONS

• Notwithstanding the other provisions of this Policy, We may refuse to provide repair, replacement,or refund for a product or service you purchased if:
• I. the product purchased is sale items or promotional items (discounts, giveaways, etc.).
  II. if the product has been used or opened.
  Ill. the products are not in the same condition as when they were delivered.
  IV. misused the product in a way that caused the problem.
  V. You knew or were made aware of the problem(s) with the product or service before
  you purchased it.
  VI. Gifts or free services.
  VI. the product is broken, tampered or damaged.
  VIll. the product is returned after the return window is closed or the Refund Period expires.
  IX. Any other exceptions apply under the Consumer Protection Act, 2019.
• Apart from the aforementioned goods and services, the following goods and services are not eligible for a refund: Clicker Service Fee

7. SHIPPING COST

• Any shipping cost for returning the products will be incurred by Us.

8. YOUR DATA

• The privacy of your data supplied to Us during the return and refund procedure is also governed by our privacy policy.

9. RESPONSE TIME

• Responses are normally processed within 14 Business Days after the completion of quality checks of the product returned.
• The period of refund may also depend on various banking and payment channels, and We will not be liable for any errors or delays in a refund due to banks or third-party service providers.
